These terms govern your use of the TrueWork mobile app, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these terms.

1. Acceptance
When you create an account on TrueWork, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
These terms form a binding agreement between you and Cloudhood, Inc. ("TrueWork", "we", "us"). You should read them carefully.
2. Description of the service
TrueWork is an anonymous peer-evaluation service for retail and service teams. Owners set up evaluation cycles, employees evaluate one another anonymously, and aggregate results are published to the people entitled to see them.
The Service does not produce employer reviews, hire/fire recommendations, or compiled ratings used as the sole basis for an employment decision. It provides aggregate signals from employees to their teams and is one input among many that managers may consider.
3. Eligibility
You may use the Service if you are:
- At least 16 years of age, and
- Either (a) a store owner or operator setting up a workspace for your team, or (b) an employee invited by an owner to join their workspace, or (c) a member of the public viewing a TrueResume share link.
If you live in a jurisdiction where 16 is below the age of majority for digital services, you also confirm that you have the consent of your parent or legal guardian.
4. Accounts
You shall provide accurate registration information and keep it up to date. You are responsible for safeguarding your password and any actions taken with your account. Notify us immediately at hello@thetruework.com if you suspect unauthorized access.
One account per person. You shall not impersonate someone else, create accounts for fictitious people, or share access credentials with a third party.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to defeat, bypass, or interfere with the anonymity protections built into the Service.
- Attempt to identify another user's evaluation submissions, votes, or reports through technical or social means.
- Coerce, intimidate, or retaliate against anyone for participating in evaluations.
- Submit false evaluations, fabricated reports, or coordinated voting blocs intended to manipulate aggregate results.
- Reverse-engineer, decompile, or attempt to extract source code from our applications.
- Use automated tools (bots, scrapers, headless browsers) to access the Service without our prior written permission.
- Interfere with the operation of the Service, including by overloading it, probing it for vulnerabilities outside an authorized security disclosure program, or distributing malware through it.
We may suspend or terminate accounts that violate this section.
6. Owner obligations
If you are an owner using the Service to evaluate your team, you agree that:
- You will not use the Service to retaliate against employees for the content of evaluations, the anonymous reports they file, or for using the Service at all.
- You will not attempt to identify individual evaluators or vote contributors through pattern analysis, timing, process of elimination, or any other technique.
- You will treat the published aggregate results as one input among many, not as the sole basis for any employment decision.
- You shall comply with all applicable employment laws in your jurisdiction. The Service is a tool you operate; you are the employer.
- Your subscription is per store. Adding additional stores adds additional subscriptions.
7. Employee obligations
If you are an employee using the Service, you agree that:
- You will submit honest evaluations to the best of your knowledge.
- You will not collude with other employees to artificially raise or lower a teammate's results.
- You will not use the anonymous-report feature for personal harassment, fabricated allegations, or matters that have nothing to do with the workplace.
- Your published evaluation history is portable and yours. You may share it via TrueResume; the Service does not authorize anyone else to share it on your behalf.
8. Anonymity is sacred
The anonymity guarantees described in our Privacy Policy are core to the Service. We treat any attempt to circumvent them — by employees, owners, or third parties — as a material breach of these terms, grounds for immediate termination, and where applicable a violation of law.
9. Subscriptions and billing
Free tier
Stores with five or fewer team members may use the Service at no cost. Free-tier accounts have full functionality except for advanced features reserved for paid tiers.
Owner subscriptions
Owner subscriptions for stores with more than five members are billed monthly per store through Stripe, Inc. Current tier prices are provided when you set up billing and are confirmed on your receipt. Upgrades take effect immediately and the prorated balance is charged on the day of the change. Downgrades take effect at the end of the current billing period.
Employee Premium
Employees may optionally subscribe to Premium for $2.99/month through Apple App Store or Google Play. This subscription is billed by Apple or Google under their respective terms. Your employer cannot see whether you have Premium. Premium unlocks full evaluation history, TrueResume sharing, and Growth Pattern View.
Taxes
Prices do not include taxes. Where required by law, applicable sales tax, VAT, or GST will be added at checkout.
10. Cancellation and refunds
You may cancel a subscription at any time from in-app settings (or via Apple/Google for Employee Premium). Cancellation takes effect at the end of the current billing period. No partial refunds are offered for unused time within a billing period, except where local law requires otherwise.
If you cancel and the cancellation drops a store below the five-member free-tier limit, the account continues operating on the free tier.
11. Intellectual property
The TrueWork name, logo, and the software and design of the Service are the property of Cloudhood, Inc. You shall not copy, modify, or distribute them without our written permission, except for limited fair use in commentary or reporting about the Service.
You retain ownership of the evaluation submissions, votes, and reports you contribute. By submitting them you grant us a worldwide, royalty-free license to process them as necessary to operate the Service, including computing aggregate results that other users see.
12. Termination
You may terminate your account at any time from Settings → Delete account. Account deletion is described in our Privacy Policy.
We may suspend or terminate your account if we reasonably believe you have violated these terms, if we are legally compelled to, or if we discontinue the Service. We will provide reasonable notice except in cases of clear and serious abuse.
On termination, your right to use the Service ends. Provisions of these terms that by their nature survive termination — anonymity protections, intellectual property, liability limitations, and dispute resolution — survive termination.
13. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.
TrueWork is not an employment decision-maker. We provide signals; you decide. We are never the reason someone was hired or let go. Aggregate evaluation results reflect anonymous peer feedback and are not, on their own, a determination of any employee's overall value, suitability, or work quality.
14. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall TrueWork, its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total cumulative liability to you for all claims arising out of these terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars (USD $100).
15. Dispute resolution
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and TrueWork agree to first attempt to resolve any dispute informally by contacting hello@thetruework.com. If we cannot resolve it within 60 days, either party may bring the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
Class actions and class-wide arbitrations are waived to the extent permitted by law. If you are an EU or UK consumer, this section does not deprive you of mandatory rights under the law of your country of residence.
16. Changes to these terms
We may update these terms from time to time. When we make a material change, we update the "Last updated" date and notify active users in the app or by email at least 30 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms.
